
The national commissioner of Migration, Francisco Garduño Yáñez, received a conditional suspension of the criminal proceedings against him after the incident on March 27, 2023, at the immigration station in Ciudad Juárez, Chihuahua. This Saturday, a video began circulating showing the official traveling in first class, which generated criticism on social media, especially due to his alleged indirect responsibility in the fire that caused the death of 40 migrants and left 27 people with severe consequences.
In the video, Garduño Yáñez is seen resting in first class, a fact highlighted by Grupo Fórmula reporter Andrea Meraz, who pointed out that the official seems to be backed by the government of the "Fourth Transformation." This situation has drawn attention because traveling in first class does not align with the austerity principles promoted by this government.
The suspension of the criminal proceedings means that Garduño must comply with certain measures over the next 18 months, such as offering public apologies, ensuring compensation to the victims, and participating in workshops on human rights. Despite these conditions, the news has sparked intense controversy and reactions from human rights organizations, which have expressed their disagreement with the judicial ruling.
Additionally, as part of the imposed measures, Garduño will need to quarterly verify immigration inspection centers to ensure compliance with safety and civil protection standards. Organizations such as the Foundation for Justice and the Democratic State of Law, Sin Fronteras IAP, La 72, and Asylum Access Mexico have expressed their concern regarding the potential lack of transparency in the handling of the case and the limited participation of civil society in judicial proceedings.
