Proposal for Rental Rights Protection in Mexico City

The Morena deputy, Alberto Vanegas, presented an initiative in the Congress of Mexico City to address the issue of high requirements in lease contracts in the capital. This proposal seeks to amend article 2448-F of the Civil Code with the aim of protecting those facing unfair obstacles to access the right to housing.

At a press conference at the Donceles venue, Vanegas highlighted the importance of establishing a balance between landlords and tenants, protecting those who rely on leasing as their only housing option. The initiative proposes to prohibit requiring guarantees with real estate of equal or greater value than the rented housing, advance payments of several months' rent, and the signing of blank promissory notes in lease contracts.

Vanegas emphasized that access to housing has become an economic and social challenge for many families, with alarming increases in rental costs and abusive practices in lease contracts that can even lead to real estate corruption. According to cited figures, in Mexico City, 44% of tenants' income is allocated to paying rent, exceeding the UN-Habitat recommendation that this expense should not exceed 30% of salary.

Vanegas's proposal is inspired by international experiences and the current government's policies, such as the construction of social housing in Mexico City promoted by the head of Government, Clara Brugada. The deputy emphasized that the initiative does not seek to affect private property but to regulate abusive and disproportionate practices in lease contracts, with the aim of establishing a standard of justice for both parties involved. The proposal has been referred to the Administration and Justice Procurement Commission.
