Two security guards, Iván “N” and José Eusebio “N”, have been linked to process for charges of resisting authority and operations with illicitly sourced funds. For this reason, the van was towed by a crane and taken to the Public Ministry, with the guards inside. The defense told the media that during the hearing they presented proof that accredits the legal origin of the seized money and stated that there was no resistance to authority. Both face charges for resisting authority and operations with illicitly sourced funds in the hypothesis of cash transfer. On December 19, both individuals were detained while driving on Lomas Verdes Avenue, in Naucalpan, aboard a Dodge Durango van in which they were transporting 37 million 701 thousand pesos in cash. The defense stated that the cash was part of the regular operations of value transfer. According to the initial report of state police, the detention originated under the argument that the vehicle exceeded the speed limit allowed. The defense maintained during the hearing, which lasted more than seven hours, that the records of the unit indicated that it was traveling at an approximate speed of 40 kilometers per hour. When the police stopped them, the guards did not descend from the vehicle, in adherence, according to the defense, to the internal security protocols that the company has. In that sense, he pointed out that the linkage was decreed “without reasonable indications” by the Public Ministry, so he announced that he will file an appeal considering that the evidence was not properly evaluated by the judge. In addition, he assured that complaints will be filed against the police who made the detention, for the alleged violation of human rights of the two guards. Iván “N” and José Eusebio “N” will remain confined in the Barrientos prison while the investigations continue. The judge set a two-month deadline for the closure of the complementary investigation. On December 23, the authorities of the State of Mexico reported the detention of the two men, the seizure of two firearms and the cash, as well as the impossibility, according to the official report, to accredit at that moment the legal possession of the money.
