The Attorney General's Office (FGE) determined that, despite holding a degree in Law, the accused illegally practiced psychiatry. So far, at least five complaints against her have progressed, some of the victims have had records since 2019. During a mobilization, it was reported that hearings for the crime of threats have been postponed twice, which was qualified as an irregularity.

The accused faces criminal proceedings for professional usurpation and is in preventive detention at the Women's Penitentiary Center of Ciudad Serdán while the complementary investigation is underway. Marilyn Cote was arrested on November 23 in the municipality of Tlaxco, Tlaxcala, her place of origin. Complaints against the "pseudo psychiatrist" have increased to about 20 approximately three months after the case went viral, but no sentence has yet been issued.

After being linked to the process, a hearing was scheduled at the San Andrés Cholula Justice House on January 30 to address the charges against her. However, at the end of the hearing, which lasted more than two hours, the victims reported that the judge decided to postpone the process and call for a new hearing for the following week. The next hearing will take place on February 4 at 1:30 PM due to Cote's request for a duplication of the term, an additional period she is entitled to request as the accused.

Patients and alleged victims of Cote demanded the Judiciary to expedite the issuance of a sentence, arguing that the criminal process against her has been unjustifiably prolonged. Under the slogan "Marilyn Cote, we want you in jail", protesters demonstrated this Thursday outside the Justice House.
