INAI Recommendations on AI and Privacy

INAI has published recommendations on the processing of personal data and artificial intelligence, highlighting its importance for privacy and rights in Mexico.

INAI Recommendations on AI and Privacy

The National Institute of Transparency, Access to Information, and Personal Data Protection (INAI) has published the "Recommendations for the Processing of Personal Data Derived from the Use of Artificial Intelligence." These recommendations aim to disseminate knowledge about the relationship between Artificial Intelligence (AI) and the right to the protection of personal data. This action is framed within the commemoration of International Data Protection Day, highlighting the importance of privacy in relevant contemporary issues.

In 2025, it is expected to address the impact of AI on privacy through a multidisciplinary dialogue that evaluates the challenges and opportunities this technology presents. INAI is promoting spaces for reflection that allow for the analysis of technological phenomena under ethical principles that guarantee the well-being of all.

The advancement of AI poses significant uncertainties regarding privacy and the protection of personal data, fundamental rights enshrined in the Mexican Constitution. The processing of large amounts of information by generative AI models raises questions about the awareness of data holders and their preparedness to face the ethical and legal implications of these technologies.

In Mexico, there are laws that recognize rights such as access, rectification, cancellation, and opposition (known as ARCO rights) in relation to the protection of personal data. However, the rapid development of AI raises the need to review these regulations to ensure their adequacy to current challenges.

One of the main challenges of AI is algorithmic transparency, which requires individuals to understand how their data is processed and how automated decisions may affect their lives. Regulation must focus on ensuring that AI systems are fair, explainable, and auditable.

Moreover, it is essential to learn from international cooperation to adapt best practices in the treatment of personal data and close the regulatory gap, balancing technological innovation with the protection of fundamental rights. AI not only represents risks but also opportunities to improve the country's conditions, provided that responsible and ethical technologies are developed.

In the era of AI, privacy becomes an ethical and social issue, not just a technical one. It is crucial to promote a regulatory framework that guarantees privacy and fosters a secure digital environment for all Mexicans. Generative artificial intelligence stands out as a powerful tool with the potential to transform various aspects, from artistic creation to complex decision-making.
