Controversy Surrounds Homicide Charges Against 14-Year-Old

The head of the National Institute for Women, Citlalli Hernández, recently met with the prosecutor of Querétaro, Víctor Antonio de Jesús Hernández, to address the case of a 14-year-old girl accused of homicide following an alleged miscarriage. The institution requested a three-year prison sentence and a fine of more than 500,000 pesos for the young girl.

In her meeting with the prosecutor, Hernández emphasized the importance of finding a swift solution to protect the rights and integrity of the girl. Additionally, she mentioned that the governor of Querétaro, Mauricio Kuri, showed willingness and support in the case.

President Claudia Sheinbaum instructed Hernández to follow up on the case and ensure justice for the community. Hernández reiterated to Mexican women that they are not alone and that efforts are being made in their defense.

The case became public after a report from the collective Adax Digitales, which revealed that the Querétaro Prosecutor's Office accused the minor of qualified homicide following an involuntary abortion that followed an alleged rape by a relative. The Prosecutor's Office sought reparation for damages of 518,000 pesos, allocated to the alleged aggressor despite establishing his paternity.

The Prosecutor's Office claims there is no basis for an accusation of rape against the young man, and the investigation was based on the minor. Adax Digitales, representing the young girl, pointed out that the evidence presented by the Prosecutor's Office, such as testimonies about the minor's sex life, are revictimizing and not related to the case.

Currently, the minor is under house arrest in Huimilpan. The trial will continue, and a date is expected to be announced soon. The defense emphasizes that the minor was unaware of her pregnancy and sought help upon detecting bleeding, which contradicts the accusation of mechanical asphyxiation of the fetus.

Adax Digitales criticized the lack of follow-up on the report of the minor's rape, highlighted by a positive paternity test implicating the alleged aggressor.
