
The recommendation issued by the Human Rights Defense Office of Querétaro against the Attorney General's Office and the Public Defense Office, in the case of Esmeralda, is being contested due to the lack of accountability assigned to other authorities, according to Mayra Dávila Alvarado, lawyer and founder of Adax Digitales. Emphasizing that this is not just about the case of Esmeralda, she highlighted that many women do not receive adequate attention when seeking help from medical, judicial, and rights defense institutions, which is why a thorough review by the National Human Rights Commission is expected.
In this regard, Mayra Dávila Alvarado commented: "It was contested because we do not agree that only two institutions have been held accountable; we believe this requires a deep investigation, and it was not just two institutions involved in the case, there were more, and they also did a poor job in defending the minor, and recommendations should also be made for them to improve their actions." Additionally, she pointed out that the process for comprehensive reparation for the damage caused to the minor, her father, and her sister is currently stalled due to this contestation.
The State Commission for Comprehensive Attention to Victims prepared reports on the emotional state of the minor; however, as defenders, they are presenting their own expert opinions to be considered in this matter. On the other hand, they are working with the Attorney General's Office on following up on the recommendations, especially regarding staff training to ensure gender-sensitive assistance, and a cooperation agreement is expected to be signed in March.
Furthermore, they are following up on the case of missing women in Jalpan de Serra, which is about to complete a year, working with a multidisciplinary team to review the case file in detail, propose new searches, and establish deadlines for the submission of reports in the investigation. The Jalpan Attorney's Office has also been subject to a recommendation in this case.
