MusicVibe, a promoter facing multiple fraud and debt accusations, will be sanctioned by up to one million pesos by the Tijuana City Council for violating the conditions of its permit for the Junior H concert. Municipal Secretary of Government, Arnulfo Guerrero León, announced this in advance.
The infringement was due to holding the show on a different date than the one authorized. The concert was scheduled for Sunday, November 9th, but it did not start until the early morning of the following day, after being delayed by nearly 7 hours.
In media statements, Guerrero León confirmed that the sanction process is underway: “The sanction will be for non-compliance with the day of the event… It was not the correct day, it was another day.” The official explained that the promoter justified the date change by claiming a delay in the artist's arrival, caused by foggy conditions in the region. However, the secretary emphasized that this justification does not exempt the company from its administrative responsibility for operating outside the terms of its permit.
“The fine for this infringement can reach up to one million pesos,” he reiterated.
Before the concert, MusicVibe boasted that all tickets were sold out. Meanwhile, images of people waiting for hours for the show to start circulated on social media.
“Thousands of fans remained on standby for hours, while others chose to leave before his arrival. The foreign company never told attendees that their money would be returned, and this is not the first time this company has defrauded the people of Baja California,” stated journalist Víctor Lagunas Peñaloza.
Constant violations of the law and other fines for MusicVibe
As documented by Aristegui Noticias, MusicVibe and its ticketing agency FunTicket have violated the Consumer Law on hundreds of occasions, for which the Federal Consumer Prosecutor's Office (Profeco) has imposed multimillion-dollar sanctions. Furthermore, audits, contracts, and internal emails, as well as dozens of documents obtained through transparency requests, reveal how both companies implemented multimillion-dollar fraud schemes, overselling, reselling, and possible tax evasion, as shown in the report “Así opera la fraudulenta empresa detrás de los conciertos de Luis Miguel, Daddy Yankee, Travis Scott, Tool y más…” published in February of this year.
The fines that Profeco has imposed on FunTicket between November 23, 2023, and August 22, 2024, total 6,163,750.49 pesos. According to information obtained by this medium through information requests, during this period, FunTicket, whose corporate name is La Florida Equipos y Suplementos, was subject to 1,442 fines or enforcement measures.
These sanctions have different motives, ranging from failing to appear at conciliation hearings to not submitting reports or delivering requested documentation to the authorities.
MusicVibe's irregularities in Tijuana with Luis Miguel
Ticket overselling is not just a financial loss; it endangers people's lives by exceeding maximum capacities and safety measures stipulated for concerts. The risk that MusicVibe puts its clients in is shown in the discrepancy between the tickets sold and the maximum capacity with which it contracted the life insurance for Luis Miguel's 2024 tour. For example, the policy issued by GMX Seguros, obtained by Aristegui Noticias through transparency, indicates a maximum capacity of 27,461 people for the concerts held on September 4th and 5th at the Caliente Stadium in Tijuana. Despite this, the city council authorized permits stipulating a capacity of 28,000 individuals. This concert was also touted as a sell-out by MusicVibe.
