Proposal to Improve the Patent System in Mexico

The plan aims to increase national patents in Mexico through a trans-institutional infrastructure and a reduced patent processing time system, promoting public innovation and competitiveness.

Proposal to Improve the Patent System in Mexico

In Mexico, there is a proposal to implement a tool that has been successful in the United States and could significantly increase the number of patents granted to Mexicans. This step is fundamental if one wishes to compete effectively in the production of legally protected technology. The importance of creating long-term infrastructure that supports innovative projects with potential impact in relevant areas is emphasized.

The patent system is considered crucial for legally protecting innovation, granting the innovator the exclusive right to exploitation and facilitating the commercialization of such rights. In Mexico, the low number of technologies produced is not reflected in an efficient use of the patent system to convert innovation into a competitive advantage.

Among the highlighted efforts to promote public innovation and technological development in the country is the creation of the Secretariat of Science, Humanities, Technology, and Innovation and the advisory council of IMPI. Improving the patent acquisition times is seen as a key factor for Mexican innovators to take advantage of the benefits of intellectual property.

A proposal to improve the patent system is the implementation of a simplified provisional mechanism that allows for the submission of a general description of a new technology, without requiring formalities, as an initial reservation before filing a patent application. The low number of patents granted to Mexicans, in contrast to the high number of applications submitted by foreigners, highlights the need to improve this aspect.

The National Development Program 2025-2030 has a clear objective to make Mexico a scientific and technological power. To achieve this ambitious goal, it is necessary to quickly unite the necessary efforts and actions, considering all the pieces of the puzzle and working together towards a future of greater innovation and technological development in the country.
