Some amparo judges have been ignoring what the Constitution establishes regarding democracy in Mexico. On the other hand, the Electoral Tribunal has not invaded the powers of other authorities or bodies, as there is an autonomous judicial system specialized in resolving electoral conflicts. The selection of candidates remains an electoral issue, and the Electoral Tribunal has the final word on this matter.

The recent decision by the Senate to resume the selection of candidates that the Judicial Branch Committee was supposed to conduct is a measure that guarantees compliance with the optimal conditions for citizens, according to the Constitution. Although there may be divergent opinions on the election of judges by popular vote, judicial reform is already part of the Constitution and must be obeyed by all.

The Electoral Tribunal is ensuring democracy and the rule of law by requiring institutions to comply with the preparatory acts for the election. The Superior Chamber of the Electoral Tribunal is the highest authority on electoral matters, and no other entity can intervene in these issues or limit its powers.

Some federal judges have issued suspensions of amparo aimed at obstructing the scheduled judicial election on June 1. The most recent case was in Michoacán, where the activities of the Judicial Evaluation Committee were suspended, creating uncertainty among candidates. In light of this disobedience, the Electoral Tribunal ordered the resumption of evaluations.

The Tribunal has delivered an important ruling by ordering the Senate to conclude the selection processes that should have been carried out by the Judicial Branch Committee. This decision has been criticized, but it actually aims to ensure a free and organized judicial election, to the benefit of candidates and citizens. This measure aligns with the provisions of Article 41 of the Constitution and is part of a reform that seeks to improve the judicial system for the benefit of society.
