
The Electoral Tribunal declared its order unmet, requesting the Senate to conclude the election of candidates through a lottery draw. The resolution indicates that the result of the draw will be sent to the INE, regardless of the approval of the Supreme Court. Once the list is obtained, it will be sent to the National Electoral Institute to conduct the election.
However, the committee responsible for selecting candidates halted its work to comply with a provisional suspension dictated in the context of an amparo lawsuit against the secondary laws of the judicial reform. The Plenary of the Supreme Court of Justice of the Nation voted on the candidacies sent by the Senate for the Extraordinary Electoral Process 2024-2025 of the Federal Judiciary, following the lottery draw.
During the private session on February 6, different viewpoints were presented by the present ministers. The voting failed to achieve the majority of 8 votes required by the constitutional reform regarding the Federal Judiciary. Ministers Lenia Batres, Yasmín Esquivel, and Alfredo Gutiérrez Ortiz Mena voted in favor of validating the candidacies, while Ministers Javier Laynez Potisek and Ana Margarita Ríos Farjat were absent from the session.
The original procedure established that the candidates would be selected by the Judicial Evaluation Committee and subsequently approved by the Supreme Court. Given the contradictory judicial orders, the committee decided to appeal to the highest judicial instance, generating some complications in the election process.
