The First Chamber of the Supreme Court of Mexico, headed by Minister Margarita Ríos Fajart, aims to analyze a case in which a father sued an insurance company for refusing to sell a major medical expenses insurance policy to his daughter due to her genetic condition of Down syndrome. This review could raise a new approach regarding the limits of the contractual freedom of insurers, especially in cases of disability, and the reinforced duties when it comes to minors. The case could lead to significant changes in how the insurance industry has addressed such situations so far.
