
The parliamentary faction of Morena in the Chamber of Deputies has presented a reform initiative to prohibit the use of the image of girls, boys, and adolescents in political-electoral propaganda. The proposal, promoted by deputy Azucena Arreola Trinidad, aims to add provisions to the General Law of Institutions and Electoral Procedures.
Deputy Arreola Trinidad argues that although national legislation recognizes constitutional principles such as the best interests of the child, there is currently no electoral rule that clearly prohibits the use of minors' images in political campaigns. According to the federal legislator from Chiapas, it is essential to protect the image of minors as part of their right to personality, preventing their exploitation in campaigning activities.
In this regard, Arreola Trinidad emphasizes that both the National Electoral Institute (INE) and the Superior Chamber of the Electoral Tribunal of the Federal Judiciary (TEPJF) have issued isolated criteria regarding the use of minors in political propaganda, but she believes that there is no clear legal provision prohibiting this practice. The deputy denounces that the use of minors in propaganda has been allowed based on the consent of parents or guardians, without taking into account that the personality rights of minors are inalienable.
"The special protection of the image of girls, boys, and adolescents must be one of the fundamental principles of our social coexistence system," emphasizes deputy Arreola Trinidad, who insists that minors do not have the maturity or resources to defend their rights by themselves.
