The Supreme Court of Justice of the Nation (SCJN) of Mexico made a landmark decision on November 13 that could benefit thousands of retired workers of the Mexican Social Security Institute (IMSS). According to the Argentine News Agency, the Full Court approved, by a majority of seven votes, to exercise its Power of Attraction (request 677/2025) to rule on a historic lawsuit regarding the savings of retirees. The court decided on the issue of workers being forced to change shifts. The debate centers on determining whether retirees under the old regime have the right to have the funds accumulated in their individual accounts in the categories of Advanced Age and Old Age Severance returned. While the court's decision is not a final sentence ordering an immediate return, it is a crucial procedural step. By attracting the cases, the SCJN seeks to unify criteria, as various Collegiate Courts had differing opinions on the matter. This measure ensures that it will be the Supreme Court that resolves the issue with a single interpretation, providing legal certainty at the national level. If the final ruling is positive for the retirees, the resolution will become binding jurisprudence, and the IMSS would be obligated to return the funds.
