First Woman Linked to Process for Vicarious Violence in Coahuila

In the Mexican state of Coahuila, Stella 'N' has become the first woman to be linked to a process for vicarious violence. This case could set a legal precedent, as the figure of vicarious violence had previously only been applied to men. The prosecution alleges that the accused used the children to cause emotional harm to the father.


First Woman Linked to Process for Vicarious Violence in Coahuila

With this process, Stella 'N' becomes the first woman linked to vicarious violence in Coahuila, a fact that could set a legal precedent in the application of this figure, whose visibility in the state is still recent. The first documented case, and under judicial process, of vicarious violence in Mexico occurred in Yucatán in July 2024, when a man was linked to process in Mérida for this crime along with illegal deprivation of liberty. According to the accusation, he would have detained his two children to prevent the mother from recovering them, causing emotional harm to the victim. This precedent is considered a benchmark for subsequent cases, including the recent process against Stella 'N' in Coahuila, which marks the first linking of a woman in the entity under this legal figure. A control judge linked Stella 'N' to process for the crime of family violence in its modality of vicarious violence, in accordance with article 251 of the Penal Code of Coahuila. The ruling was issued on Monday, after a hearing of approximately six hours in which the Prosecutor's Office presented evidence that, according to its version, indicates that the children of the couple would have been used to cause emotional harm to the father, Johnny Robles. After the hearing, Robles expressed that the linkage to process against his ex-partner seeks to protect his children. "It is to fight for our childhood, for our children, so that they can grow up healthy physically and emotionally." He assured that the complaint aims to guarantee the right of minors to maintain a bond with their paternal figure and avoid psycho-emotional damage. Vicarious violence, included in the Penal Code of Coahuila since 2023, establishes that it is a crime for anyone, by action or omission, to use children or other people in a situation of dependence to cause harm to another person, generating psycho-emotional or physical affectations. The Penal Code of Coahuila contemplates for this crime penalties from six months to six years in prison, as well as possible restrictions on parental authority, visitation regime and succession rights, in addition to other security measures determined by the judge. According to the allegations, Stella 'N' would have repeatedly prevented contact between the children and the father, in addition to carrying out actions aimed at weakening the parent-child bond. The defense of Stella 'N' rejected the charges and announced that it will appeal the linkage and the precautionary measures, which include the obligation to appear monthly to sign at a court in Colima, where she currently resides. In addition, the defense pointed out that the accused appeared voluntarily and recalled that months ago a judge had decided not to link her to process for lack of evidence. Currently, she maintains custody of her children by resolution of a family court, a situation that, according to her defense, cannot be modified from the criminal sphere. On the other hand, the collective 'Parents for the Truth', which has accompanied the case, warned about the importance of knowing the complete story before issuing judgments. "Our cause is not a gender struggle. We ask that the well-being of children prevail over any couple conflict."
