Mexico Vows to Comply with Court Ruling in Woman's Rape Case

On her morning conference on December 17, President Claudia Sheinbaum assured that her government will comply with the actions ordered by the Court. Pablo Mendizábal, a forensic examiner in the Ernestina Ascencio case, stated in an interview that the ruling by the Inter-American Court of Human Rights confirms what he and other experts had maintained from the beginning and exposed the professional and personal consequences he faced for upholding his findings. After completing the autopsy, the forensic team reported signs of sexual assault. Mendizábal recounted that after this report, they faced a series of institutional pressures. He stated that after 17 years, the international resolution confirms his professional conduct. The forensic examiner described a pattern of persecution that, he claimed, extended across different governments. He indicated that he was suspended from the Prosecutor's Office and subsequently fired without severance pay. In the context of the Court's ruling, Mendizábal called on the current authorities to intervene in his case. The Attorney General's Office (FGR) announced that it has taken jurisdiction over the case of Ernestina Ascencio Rosario, a 73-year-old Nahua indigenous woman who was a victim of sexual assault and torture by soldiers and died the next day without receiving adequate medical care. The events occurred on February 25, 2007, in the community of Tetlatzinga, Veracruz. The Inter-American Court determined the responsibility of the Mexican state and ordered measures such as reopening the investigation and providing reparations.
