Judge orders Mexican Prosecutor's Office to ensure transparency in fuel smuggling case

Control Judge Mariana Vieyra Valdés ruled that the General Prosecutor's Office (FGR) must provide full transparency in the investigation against Vice Admiral Manuel Farías, accused of fuel smuggling. The ruling allows private experts to assist the defense in reviewing the case file. The Prosecutor's Office must provide all documents and explain how the defense's requests were handled. This measure aims to reinforce procedural transparency and the rights of the accused.

This access will include the presence of private experts, who may accompany lawyers in the review of the file, having to request the corresponding appointments by email or in writing so that there is a formal record of said requests. Faced with the controversy raised during the hearing—derived from the fact that various requests from the defense would not have received formal agreement from the Public Ministry—the judge determined a mechanism of judicial assistance to review the follow-up of said petitions point by point. In this sense, the defense of the vice admiral must inform the court of all the investigative acts that it has requested, while the Public Ministry must explain how it has addressed each of them, allowing the court to review the Prosecutor's Office's actions point by point. For the Mendieta & Asociados firm, this judicial resolution reinforces the principle of procedural transparency and guarantees that the exercise of the defense is carried out with full access to the information contained in the investigation file. Currently, the former high command of the Navy is held in the Altiplano prison, in the State of Mexico. The Control Judge Mariana Vieyra Valdés ordered the General Prosecutor's Office (FGR) to make transparent the entire investigation file followed against Vice Admiral Manuel Roberto Farías Laguna, imprisoned in a case of fuel smuggling, or 'huachicol'. The vice admiral was detained in September 2025 for his alleged involvement in a fuel smuggling network, known in Mexico as 'fiscal huachicol'. According to a communiqué issued by lawyer Epigmenio Mendieta, -the vice admiral's defender- the judge's order occurred during a hearing on the omission of acts by the Public Ministry and protection of rights, held within Criminal Case 325/2025. The judge's request also contemplates that it be informed in detail how the FGR has attended to each of the investigative acts requested by the defense of Farías Laguna. During the hearing, the judge determined that the Prosecutor's Office will have 15 business days to inform in writing how many volumes, annexes, booklets, investigation techniques, and other documents make up the investigation file, with the obligation to deliver to the defense all the documents that make it up. Likewise, the judicial resolution establishes that within the same period, the Prosecutor's Office must summon the defenses to verify the certified volumes with the original documents, allowing direct access to the investigation file so that lawyers can review the complete information and take the corresponding notes, adds the document. The judge also ordered the Public Ministry to issue the pending agreements regarding all the investigative acts requested by the defense, as well as to send the corresponding letters to the Secretariat of the Navy and the National Customs Agency of Mexico, diligences that had been previously requested. Similarly, the court instructed that 'the defense have access to the investigation file as many times as necessary, with the objective of fully guaranteeing the right to defense of the vice admiral'.
