Magistrates of the First Collegiate Court of Appeal of the Third Circuit requested a copy of the death certificate of the former leader of the Jalisco New Generation Cartel, Nemesio Oseguera Cervantes, 'El Mencho', and the document was delivered almost a month after the request. The judges learned of the death of the capo because they were aware of an appeal against the statute of limitations for an arrest warrant against him for organized crime. On February 24 of last year, two days after the criminal leader's death, they requested the document, and it was stated in the file that: 'Through various media, including the 'morning' press conference of the Federal Government on the 23rd of the current month, the death of the aforementioned accused was disseminated.' The magistrates had to respond to the appeal against the determination of the Sixth District Judge in Criminal Matters in Jalisco, 'in order to be in a position to issue the resolution that is legally appropriate.' The deadline to comply with the request was 24 hours, and a reprimand was issued to the prosecutors for 3,519 pesos and 30 cents, equivalent to 30 days' salary, in case they failed to report the impediment. Days passed with constant requests from the magistrates, while the authorities in question argued that they were managing the obtainment of both the death certificate and the death certificate, with no results. Instances of the FGR, such as the Deputy Delegate for Criminal Procedures 'B' and the Federal Public Ministry Agent attached to the court, stated they had no jurisdiction. The judges responded: 'It should be made known that these are not private documents, but public ones, and as a part and member of the Attorney General's Office, you can request them through the chain of command you refer to, either through your hierarchical superiors or the competent federal prosecutor you mention in your writing.' This Thursday, March 26, the agreement for the receipt of the official letter DGRCEJ/AJBC/148/2026 from the General Director of the Civil Registry of the State of Jalisco was issued, whereby the requested public document was sent in a sealed envelope. This left the orders to the judge and the MPF agents to deliver the death certificate void. Accusations against 'El Mencho' in limbo The Sixth District Judge in Criminal Matters in the State of Jalisco decreed the statute of limitations for the criminal action and, with it, the cancellation of an arrest warrant against the CJNG leader, on the grounds that several years had passed without him being located to execute the judicial mandate. The magistrates' request is due to the appeal of the dismissal by the Federal Public Ministry. The statute of limitations was decreed on September 28, 2025, within criminal case 53/2024 for organized crime, and the arrest warrant issued in 2012 was voided. Details about 'El Mencho's' death certificate, issued by an official from the Michoacán Civil Registry, where his death was reportedly reported on February 22 during an air transfer to Mexico City, are still unclear. However, the Jalisco Civil Registry delivered the document to the magistrates.
