
The Morena senator, Adán Augusto López, presented an initiative to modify several articles of the Political Constitution of the United Mexican States. According to him, these modifications will ensure the harmonious development of the three branches of the nation and will protect the reforms emanating from the Legislative Power.
One of the most significant changes of this initiative is that reforms and additions to the Constitution cannot be challenged or rendered inapplicable through the control of conventionality. This mechanism allowed national judges to verify that domestic norms did not contradict international human rights treaties.
Additionally, the initiative seeks to strengthen constitutional supremacy, preventing the decisions of the Reforming Power from being questioned through amparos or constitutional review lawsuits. This way, it seeks to prevent citizens from challenging norms considered to violate rights.
The proposal contemplates that once the decree is published in the Federal Official Gazette, it will come into effect the following day, repealing all provisions contrary to its content, including secondary laws, regulations, and administrative agreements. Any provision that does not comply with the new rules will be eliminated.
Furthermore, any ongoing lawsuits, appeals, or consultations questioning the validity of an addition or constitutional reform will be rendered ineffective and suspended. In summary, it seeks to limit the possibility of constitutional controversies or actions of unconstitutionality against constitutional reforms.
With these modifications, the aim is to reinforce the supreme character of the Constitution and limit the intervention of the courts in the constitutional reform processes. It is also established that State bodies must apply the reforms literally, prohibiting any interpretation that seeks to render inapplicable, suspend, or modify their terms.
In an interview with journalist Ciro Gómez Leyva, Adán Augusto López announced that the proposed modifications to Article 1 of the Constitution will be withdrawn. The decision was made to focus on Articles 103, 105, and 107 of the Constitution, with the aim of protecting the powers of the Reforming Power of the Constitution and preserving the sovereign will of the people of Mexico.
