
Minister Yasmín Esquivel expressed her intention to transform the Judiciary to bring it closer to the citizenry, allowing the doors of justice to open to listen to the parties. In an interview with the media, she highlighted her 40 years of experience and her commitment to improving the judicial system.
Esquivel Mossa announced that on November 5, the proposal presented by Minister Luis Alcántara to declare the judicial reform partially unconstitutional will be analyzed. This analysis will address whether the Supreme Court has the authority to rule on the reform.
Alcántara's document argues that the election of district judges and magistrates should be considered unconstitutional, as it undermines the autonomy and independence of the Judiciary. Esquivel Mossa stated that she has not yet expressed her position on this matter and will do so on the day of the discussion of the project.
The minister confirmed her participation in the judicial electoral process scheduled for June 2025. This decision comes following the resignations of Jorge Mario Pardo Rebolledo and Alfredo Gutiérrez Ortiz Menar as ministers of the Supreme Court on October 29. Esquivel Mossa described the opportunity to continue serving Mexico from the realm of justice as a privilege.
Alcántara's proposal also advocates for the elimination of the 'faceless judges' figure during the election of judges, arguing that it violates human and electoral rights. Furthermore, it calls for the rejection of initiatives that invalidate amparo trials, controversies, and constitutional actions against constitutional reforms approved by the Legislative Power.
