
The president of the Chamber of Deputies, Sergio Gutiérrez Luna, has presented an initiative to amend the Constitution and grant the president of the National Electoral Institute (INE), led by Guadalupe Taddei, the power to appoint the heads of the executive and technical bodies. According to Gutiérrez Luna, this proposal seeks to guarantee the autonomy of the Legislative Power against the intentions of certain INE councilors who question its will.
The proposed constitutional amendment would modify Article 41 to include the provision that the presidency of the General Council directly appoints the heads of the executive and technical bodies. It is argued that this modification aims to streamline the INE's management and operational structure, allowing for a more efficient response to the needs of the electoral process, while maintaining the principles of certainty, legality, independence, impartiality, maximum publicity, and objectivity as fundamental pillars of its operation.
On the other hand, six INE councilors have filed a petition for judicial review before the Supreme Court of Justice of the Nation (SCJN) against the new powers granted by Congress to the president councilor Guadalupe Taddei. These councilors seek to eliminate the authority that allows Taddei to freely appoint certain key officials of the Institute, as they believe this undermines the constitutional autonomy of the INE and weakens the General Council to the benefit of its president.
