The Chamber of Deputies of Mexico approved the reforms to articles 105 and 107 of the Constitution to discuss and, if applicable, validate the modifications. These reforms are crucial ahead of the scheduled discussion on Tuesday, November 5, at the Supreme Court of Justice regarding the proposal to invalidate the election of judges and magistrates from the reform of the Judicial Branch of the 4T, according to the project of Minister Juan Luis González Alcántara Carrancá.
The approval responded to the request of the Head of Government of Mexico City, Claudia Sheinbaum, for local deputies not to be absent and to vote in favor of constitutional supremacy. The reform in question was approved on September 16 with the qualified majority of the Senate, consisting of the popular election of Court ministers if the mentioned reform is annulled.
Following the notification of the resignations of eight out of eleven Court ministers starting at the last day of August 2025, the entry of newly elected ministers by popular vote is contemplated. The approval of the reforms was carried out quickly after Gerardo Fernández Noroña informed the Senate about these resignations.
The Senate of the Republic approved the reforms to articles 105 and 107 of the Constitution in a tense session. These establish the inadmissibility of actions of unconstitutionality to question additions or reforms to the Constitution. Despite the complexity of the debate, it is expected that common sense and prudence will prevail among legislators.
Ricardo Monreal Ávila, coordinator of Morena in the Senate, stated that coalition deputies met early in the Legislative Palace for the ordinary session. The 4T bench in the Chamber of Deputies approved the bill in general, achieving a new victory with 340 votes in favor.
