During the vote on constitutional supremacy in the Chamber of Deputies, Deputy Alejandro Carvajal from Morena and his allies abstained from voting. Last Wednesday night, the Chamber of Deputies approved in general and particular an initiative that seeks to modify articles 105 and 107 of the Constitution, which would prevent legislative initiatives from being halted by the Supreme Court of Justice of the Nation (SCJN).

The final vote concluded with 343 votes in favor and 129 against, allowing the initiative to advance in the Chamber of Deputies and be approved in more than 17 local congresses the next day. However, Alejandro Carvajal's abstention was notable, as members of the ruling bloc (Morena, PT, and the Green Party) usually support proposed initiatives.

Alejandro Carvajal explained that, although he is in favor of the reform to the Judiciary, he found a "technical error" in the second transitional provision of constitutional supremacy, where the retroactivity of the Constitution is established. He stated that his observation did not mean he was against the initiative but sought to correct this aspect to ensure that it complied with the Constitution, which prohibits the retroactivity of laws.

The deputy mentioned that modifications to the transitional provision in question may be made to correct this technical error, and assured that his position does not differ from that of his colleagues from Morena. During the specific vote, Carvajal did cast his vote in favor of constitutional supremacy, making clear his support for the initiative in general.
