Judicial Crisis in Mexico: Conflict between Powers

Maya García, advisor to the Federal Judiciary, has warned that if the Court decides against the judicial reform already approved, it would trigger a conflict of powers that would require urgent dialogue among the different powers. In the midst of a complicated landscape for the Judiciary in Mexico, García was clear in stating that this controversy could lead to an unprecedented institutional crisis.

In an interview with Publimetro Querétaro, García highlighted the possibility that the Supreme Court of Justice of the Nation might annul the judicial reform, which could provoke destabilization and be considered as an undue intervention by the Executive and Legislative powers. In this situation, she emphasized the importance of dialogue among the powers to prevent breaks in the institutional order.

Regarding the decision of the Federal Judiciary Council to order judges and workers on strike to resume their activities, García mentioned measures such as salary deductions and administrative sanctions in case of noncompliance. While there is a possibility of removing people from their positions, García stressed that it would be an extreme measure and would require a vote.

The resolution to apply sanctions was approved with a tight result of 4 to 3 in the CJF, with a decisive vote from counselor Molina, who had previously advocated for prolonged dialogue with the workers. This change in stance marked a turning point in the CJF and facilitated the implementation of the constitutional changes derived from the judicial reform.

Regarding her participation in the upcoming judges' election, García confirmed that she would take advantage of the opportunity that the constitutional reform provides her. She expressed her interest in running for the reviewing body, although she doubted whether to seek the election of ministers.
