Controversial Case of Minor Accused of Infant Death

In Huimilpan, a case has arisen where a minor is being accused of the death of her newborn, generating discrepancies between the Attorney General's Office of Querétaro and the version of the accused. There is a possibility that the baby was the result of a rape and that the death was due to a miscarriage.

The 14-year-old teenager, who is under house arrest, faces a request for three years in prison for strangling her newborn during childbirth. The Attorney General, Víctor Antonio De Jesús Hernández, explained that she is charged with qualified homicide because the baby was born and breathed, dismissing any evidence of sexual aggression by the child's father.

On the other hand, the organization Adax Digitales, which is collaborating in the legal defense of the case, claims that an external expert report has confirmed the rape suffered by the young woman and that the baby's death occurred in utero due to malformations. The spokesperson for the organization, Mayra Dávila, mentioned that the father denied the rape accusations, although a genetic test disproved this.

In this context, Mayra Dávila criticized the Attorney General's Office for ignoring the findings of the external expert report and for not providing support from the perspective of childhood and gender to the young woman. Additionally, she questioned the request for damages by the baby's father, expressing that it is a contradiction to allow him to claim that compensation without proving his innocence in the alleged crime of rape.

It has been announced that they will seek to meet with the Secretary of Women at the federal level, Citlalli Hernández, to seek support in a case that has gained notoriety to the point of being addressed in a morning conference where President Claudia Sheinbaum offered legal advice to the family.
