The Fifth District Court in Querétaro issued a definitive suspension of the reform to the Judiciary on Friday, October 18. This measure orders the National Electoral Institute (INE) to halt the election process for judges and magistrates. Movimiento Ciudadano deputy, Laura Ballesteros, shared the ruling of the judge regarding the amparo that establishes maintaining things in their current state and avoiding the effects of the challenged norms.

The definitive suspension against the reform to the Judiciary includes several significant points. Firstly, it orders the halt of the election process for judges and magistrates, and prohibits the removal of those holding positions in the Federal Judiciary, as well as reducing their remuneration. This comes after the controversy generated by the 'judicial lottery' that determined which magistracies and courts would participate in the extraordinary election of 2025.

The court also instructed the Senate of the Republic to suspend the extraordinary electoral process 2024-2025 for the election of judges, preventing it from issuing a call for this purpose. Activist Miguel Alfonso Meza emphasized that this decision prevents Morena from imposing its candidates and exercising control over the Judiciary. Additionally, the INE was ordered to refrain from carrying out acts related to the extraordinary election next year.

The definitive suspension against the judicial reform also prevents the mass dismissal of judges and magistrates, as well as the election of magistrates for certain positions. Furthermore, it prohibits the extinction of existing funds and contracts in the Federal Judiciary, and states that the entities of the country should not replicate the reform at the local level. Alfonso Meza highlighted that this suspension was achieved through an amparo presented alongside deputy Laura Ballesteros.

Ballesteros celebrated the definitive suspension on her social media and expressed her commitment to the fight for job security in the Judiciary. In her statements, she highlighted the importance of ensuring job stability and avoiding unjustified dismissals within the framework of the judicial reform.
