
A 14-year-old girl in Querétaro has been linked to a process for the crime of homicide after experiencing a miscarriage. The case has generated controversy following various versions of the events. The feminist collective Adax Digitales has requested that the minor not be re-victimized by the state Attorney General's office. The teenager, originally from Huimilpan, became pregnant after being the victim of a sexual assault.
The investigation was opened for the crime of abortion, according to the representative at a press conference. The young girl is under house arrest as a precautionary measure. The Attorney General clarified that the minor is being investigated under the juvenile justice law. The case took place in 2023 and the investigation was judicialized in January 2024 for homicide, leading to the minor's linking to the process.
Currently, the young girl remains under house arrest with her father and sister while investigations are carried out to determine her legal situation. During the investigation phase, the minor's defense could not demonstrate the veracity of the allegations regarding the assault, and no complaint was filed by the child's family. Investigations will continue in the coming months.
Regarding the case, President Claudia Sheinbaum expressed that "we should not criminalize, especially not a 14-year-old girl." It was reported that the Secretary of Women is providing support to the minor's family. Meanwhile, the Adax Digitales Collective has indicated that they will not abandon the legal defense of the teenager, whom they believe is being criminalized by state authorities.
The representative of the collective mentioned that the minor, identified as Esmeralda, experienced the trauma of a miscarriage following a pregnancy resulting from a sexual assault. According to the Superior Court of Justice, the baby born at 36 weeks died from strangulation asphyxia. The Querétaro Attorney General denied that the minor is being investigated for abortion and that she should compensate the alleged assailant.
For its part, Survivors Men's Project denounced that the Attorney General is requesting a sentence of 3 years in prison and compensation for the miscarriage. Local authorities have denied rumors circulating on social media about the case.
