Xóchitl Gálvez's sister, Jaqueline Malinali Gálvez, was sentenced to 89 years in prison for her alleged participation in the kidnapping gang 'Los Tolmex.' Xóchitl has publicly declared her belief in her sister's innocence due to their family relation, although she indicated that if found guilty, she must face the legal consequences. During the 12 years that Malinali was detained, Xóchitl claims she has not intervened to seek immunity through her political position.

Regarding the case, it is established that Jaqueline Malinali Gálvez served the role of 'finding victims' for the criminal gang. She is linked to the kidnapping of a couple whom she lured under the pretense of meeting her sister, Xóchitl Gálvez, who was a PAN deputy at that time. The victims were subsequently kidnapped by the criminal group led by José Alberto Rivero, known as 'El Albert.'

During her presidential campaign in 2024, Xóchitl expressed her position on her sister's case, emphasizing that Malinali had been in prison for 12 years. In 2012, the gang 'Los Tolmex' was dismantled by the now-defunct Federal Police, resulting in the arrest of several members, including Jaqueline Malinali Gálvez Ruiz. Xóchitl defended her sister, indicating that she was not involved in criminal activities, and argued that she was in a romantic relationship with one of the criminals.

Testimonies related to this criminal organization reveal that they would keep victims in cages, practiced mutilations, and exerted psychological pressure on the families for ransom payments. Xóchitl Gálvez has insisted on her attempt to help her sister at all times, reiterating her stance on Malinali's innocence and her willingness to accept the consequences if proven otherwise before judicial authorities.
