In response to speculations that Maribel Guardia was seeking to obtain custody of the minor, Imelda pointed out that Julián Figueroa, the child's father, would never allow such an action by his mother. Imelda assured: "Julián had a very big heart and would never have allowed his mother to do something like that to me. Julián Figueroa would never have permitted it, I mean never."
Amid the controversy generated by the case, a video was revealed showing Imelda Tuñón receiving a package at Maribel Guardia's house, which was alleged to potentially contain toxic substances. In light of these accusations, Imelda firmly denied having received drugs, clarifying that she was only handed packages of cigarettes and vaporizers.

However, she emphasized that she will not allow the minor to be taken away from her: "I love him with all my soul and I will never allow them to take him away from me."
