Judicial Independence Under Threat in Mexico

The judges' association (Jufed) asserts that the Electoral Tribunal's complaint against a federal judge violates judicial independence. A recent ruling has raised concerns about the integrity of the judicial system in handling electoral reforms.


Judicial Independence Under Threat in Mexico

The association of judges and magistrates (Jufed) expressed its concern over the complaint filed by the Electoral Tribunal against a federal judge, considering that this action undermines judicial independence. The complaint was filed against Santamaría Chamú, the judge who issued the suspension of the candidate evaluation committees as part of an amparo trial related to secondary laws of the judicial reform.

In a statement, Jufed described the measures taken by the tribunal as a serious violation of judicial independence. According to the union association, the judge acted in accordance with his duty to ensure that all actions of the authorities comply with the Constitution, especially in the context of the ongoing judicial reform. Jufed also pointed out that, in its opinion, the INE, as well as the Executive and Legislative branches, have repeatedly failed to comply with amparo resolutions, which constitutes a violation of the legal order.

Jufed expressed its support for Judge Santamaría Chamú in light of this resolution by the Electoral Tribunal, which, in its opinion, seeks to intimidate judges so they do not issue their rulings independently, in line with what is established by the Constitution and International Treaties. The association indicated that it will evaluate the relevant procedures against those officials whose actions undermine the independence of federal judges.
