
The Supreme Court of Justice of the Nation (SCJN) has admitted the request for the power of attraction presented by the Evaluation Committee of the Federal Judiciary (PJF) to resolve the "contradictory orders" issued by federal judges and the Electoral Tribunal of the PJF regarding the organization of the judicial election.
The head of the Evaluation Committee of the PJF, magistrate Wilfrido Castañón León, presented the request, which was assigned to Minister Alfredo Gutiérrez Ortiz Mena to prepare a resolution project that will be presented to the Plenary of the Court. This request joins three files from the year 2024 that challenge suspensions granted in the context of judicial reform, including those ordering the National Electoral Institute (INE) to suspend the organization of the judicial election.
Despite the pronouncement of the TEPJF that no judge can stop electoral norms, the INE has resumed the process and has established the bases for the election of judges, magistrates, and ministers that will take place next June. This decision has generated requests for clarification from other courts and tribunals about the contradictory resolutions related to the judicial election.
Therefore, Minister Gutiérrez Ortiz Mena must prepare a draft ruling that contemplates files 3/2024 and its accumulations 4/2024 and 6/2024, all linked to the judicial election and the powers of the Electoral Tribunal of the PJF.
After admitting the request of the Evaluation Committee, the Supreme Court has granted a precautionary measure to suspend the order of the Electoral Tribunal of the PJF to resume the judicial election process until the Plenary of the Court issues a substantive pronouncement. Additionally, the First District Court in the State of Michoacán has been required to submit the case file and the Superior Chamber of the TEPJF has been requested to present a report on the matter.
