
During an interview on the program 'Aristegui en Vivo', Judge María Emilia Molina expressed that President Claudia Sheinbaum has confusions about how the judicial system works in Mexico. She emphasized that all members of the Judiciary, including judges and magistrates, have equal authority to issue judgments and resolutions.
She recalled that the Plenary of the Supreme Court of Justice of the Nation appointed the Evaluation Committee of the Federal Judiciary, but it was two District judges who suspended the judicial election process through precautionary suspensions arising from requests in amparo trials.
In this regard, the judge noted that there has been a discrepancy between the decisions of the Electoral Tribunal of the Federal Judiciary and the orders of federal judges. In this situation, it will be the Supreme Court that will resolve these differences after admitting a request from the Committee to define the future of the judicial election.
Molina de la Puente highlighted that if a committee does not present candidates, the election will be held with nominations from other powers, leaving the seats of the Judiciary vacant. She stressed that it was not the Evaluation Committee of the PJF that halted the process and emphasized the importance of adhering to judicial orders in favor of the rule of law.
The judge expressed her concern for respect for the rule of law in Mexico, stating that it underpins democracy and that disobeying judicial orders endangers democracy and the rule of law itself. She warned that failure to comply with resolutions regarding judicial reform threatens judicial independence and access to justice for all citizens in the future.
