
The president of the Electoral Tribunal, Monica Soto, has proposed that the Senate of the Republic handle the selection process for candidates assigned to the Judicial Evaluation Committee. Soto argues that the Judicial Committee has failed to comply with a ruling that ordered the resumption of the evaluation process, considering it to be in "absolute disobedience".
The proposal arises after the Committee decided to appeal to the Supreme Court, arguing that it had received two contradictory court orders, one from an amparo judge and another from the Electoral Tribunal. In light of this situation, the magistrate suggests conducting a random draw with all candidates who meet the initial requirements, as she considers it impractical to analyze the suitability of each individual separately.
If the Committee does not approve the proposed lists, the proposal contemplates that it be considered automatically approved. The project must be debated in a public session and have the support of at least three of the five members of the Superior Chamber of the Electoral Tribunal.
In her project, the president of the Electoral Tribunal proposes that the Senate's Board of Directors take the necessary agreements to carry out the public random draw phase for candidates who have been approved regarding their eligibility requirements, given the advanced state of the process and the proximity of the deadline for submitting the list of eligible candidates.
According to the magistrate, the Senate has the authority to replace the Judicial Committee to ensure the continuity of the judicial selection process. The result of the random draw must be mandatorily accepted by the Judicial Power and submitted to the Plenary of the Supreme Court of Justice of the Nation for approval before February 6.
