TEPJF Orders Senate to Select Judicial Candidates

The Superior Chamber of the Electoral Tribunal in Mexico linked the Senate to select candidates for the Federal Judiciary using a lottery for the upcoming judicial elections. This decision aims to ensure the process follows a prior ruling addressing the non-compliance of the Evaluation Committee.


TEPJF Orders Senate to Select Judicial Candidates

The Superior Chamber of the Electoral Tribunal of the Federal Judiciary (TEPJF) has linked the Senate of the Republic to select candidates for the Federal Judiciary who will be included on the ballots for the upcoming judicial election. This selection process will be carried out through a lottery or public drawing.

In a decision made by a majority of 3 votes to 2, it has been determined that this resolution is a substitute compliance for the activities of the Evaluation Committee of the Federal Judiciary, because it is considered that the ruling of a prior lawsuit filed by candidates for positions of ministers, magistrates, and judges for the upcoming election was not complied with.

In the citizenship trial SUP-JDC-8/2025 and accumulated cases, the Superior Chamber of the TEPJF found that the ruling had not been complied with. The block of electoral magistrates that has issued rulings in favor of the current government explained that the Evaluation Committee of the PJF argued that it was unable to comply with the judicial mandate due to suspensions of injunctions granted by federal judges.

Despite this, the electoral court considered that these suspensions were not sufficient justification for non-compliance. The precautionary measure from the presidency of the Supreme Court of Justice of the Nation (SCJN) was taken into account to not sanction any member of the Evaluation Committee of the Judiciary and measures were ordered to comply with the ruling and ensure the continuity of the process.

As a result of this determination, the TEPJF has linked the Board of Directors of the Senate of the Republic to continue with the process of selecting candidates and carry out the public drawing from the list of candidates that the Evaluation Committee of the PJF deemed eligible and those that the Superior Chamber ordered to include.
