The influencer 'Fofo' Márquez rejected the abbreviated procedure and his lawyer left the case. Since being placed in preventive detention, Márquez apologized to his victim, but she did not find them sincere. A judge from the State of Mexico declared Márquez guilty of attempted femicide against the victim, identified as Edith 'N'. On January 29, he was sentenced to 17 years and 6 months in prison at the Barrientos Penitentiary, considered one of the most dangerous in Mexico.

During his time in prison, 'Fofo' will share a cell with Fer Italia, another influencer accused of rape. The Barrientos Penitentiary in Tlalnepantla de Baz has housed dangerous criminals such as 'El Mochaorejas'. A CNDH report labeled it as the worst prison in Edomex.

Márquez was arrested for assaulting the woman in public on February 22, after she accidentally hit his car. The influencer hit her and fled the scene, being arrested on April 4. After being declared guilty, he was sentenced to 17 years and 6 months of imprisonment for attempted femicide.

'Fofo's' brother, Rodrigo Márquez, reacted aggressively to the media following the sentencing. They refused to make comments and left amidst shouts against them. The sentence includes a fine and compensation for damages, as well as mandatory psychological treatment.

The Barrientos Penitentiary, where he will serve his sentence, has been the scene of riots and violent acts, including escapes. The influencer assaulted the woman in February 2024, which led to his arrest and judicial proceedings. The prison, overcrowded and with reports of illicit activities, is considered one of the most conflictive in the region.
