Oaxaca Judicial Reform Delayed Until 2027

The lawyer for the government of Oaxaca announced a delay in the local judicial reform and the election of magistrates until 2027, aiming to consolidate a more efficient Judiciary.


Oaxaca Judicial Reform Delayed Until 2027

The legal advisor and legal assistance of the government of Oaxaca, Geovany Vázquez Sagrero, reported that the local judicial reform, which includes the election of magistrates, will be postponed until the year 2027. Talks about this have been resumed with the Commission of Constitutional Studies and magistracies of the Superior Court of Justice of the State. Vázquez Sagrero explained that the governor of the state has ordered them to restart negotiations on the initiative that is in Congress and has the power to legislate and make constitutional reforms.

In a press conference, it was highlighted that a dialogue will be maintained with the magistrates and the president of the Superior Court of Justice with the objective of conducting the election of magistrates and judges in 2027. Regarding the timelines of the reform, it was clarified that those states that do not have scheduled elections in 2025 will not be affected by it.

In addition, the creation of an administrative body that will be appointed by the three powers: Executive, Legislative, and Judicial, was mentioned, which will replace some administrative functions of the Judiciary Council. This body will be proposed by each of the involved powers, in order to ensure its proper functioning.

One of the primary objectives of the reform is to establish a "Territorial Judiciary," which will include the creation of regional mixed chambers to improve the distribution of justice throughout the state. A draft report on this constitutional reform is expected to be reviewed and discussed soon.

On the other hand, the president of the Political Coordination Board of the Congress of the State of Oaxaca, Benjamín Viveros Montalvo, indicated that the delay is due to the need to have the appropriate resources for the election of judges and magistrates, scheduled for June 1. Additionally, the election of the administrative and disciplinary body is expected, as well as the reduction of magistrates from 28 to 18 and the modification of local judicial districts. The disciplinary body will supervise the performance of the magistrates.
