Supreme Court Faces Constitutional Crisis

The Mexican Supreme Court is set to address a critical decision regarding its authority against the backdrop of political defiance of constitutional law and judicial rulings.


The Supreme Court of Justice will discuss a relevant resolution addressing the situation in which constituted bodies decide to disobey the constitutional court, stepping out of the rule of law. Minister Gutiérrez Ortiz Mena presented a project related to the conflict between the Superior Chamber of the Electoral Tribunal and several amparo judges regarding the validity of suspensions against the judicial reform.

The project highlights the importance of determining which jurisdiction should prevail to restore regularity and the strength of the Constitution. The arrogance of the electoral tribunal magistrates who have disobeyed the decisions of the courts is questioned. The need to comply with what each individual recognizes as the Constitution is emphasized, as well as the importance of respecting the authority of the law.

It is mentioned that by disobeying the constitutional court, it may cease to exist due to the loss of the Constitution. The situation of disobedience and the will to power that subverts the legal order is addressed, questioning the necessity of respecting institutional means. Despite the potential catastrophic consequences, it is highlighted that the voting will be anecdotal, regardless of the reprimand to the actors of the crisis.

Finally, the challenge of what happens if the determinations of the constitutional court are disobeyed or ignored is raised, recalling the assertion that over the decisions of these courts "not even God the Father". There is reflection on the activism of judges seeking to protect their life projects, and the unlimited capacity of a curia to influence all aspects of life is questioned.
