Lilia Mónica López Benítez, magistrate and member of the Federal Judiciary Council, has sent a letter to the Senate and the National Electoral Institute (INE) to express her displeasure at being included in the list of candidates for the first judicial election without her authorization.
In the document, the magistrate made it clear that she never requested or expressed her willingness to participate as a candidate for the Judicial Discipline Court, and since October 30, she had indicated that she would not participate in the electoral process. López Benítez stated that she was given a "direct pass" to participate in the process, despite the fact that the judicial reform did not consider her for the new Judicial Discipline Court.
In her statements, the magistrate expressed her conviction that justice should not be subjected to the logic of political and electoral processes, but rather its essence lies in the strict application of the law, detached from partisan interests or political situations. The inclusion of her name in the candidate lists, despite her public and documented resignation to participate in this process, violates her fundamental rights and transgresses her explicitly expressed will.
Lilia Mónica López Benítez demanded the immediate rectification of the list sent to the INE and requested an official statement from the Republic's Senate and the INE, clarifying that she does not wish to participate in any judicial election process. Additionally, she held the legislative authority responsible for any improper use of her name in this process and reserved the right to take appropriate legal and constitutional actions to protect herself and her professional trajectory committed to justice and the dignity of the public service of administering justice.
