Critical Concerns Over Judicial Reform in Mexico

Judge María Emilia Molina de la Puente expressed her concern about the changes in the jurisdictional system of the Judiciary, highlighting the violation of constitutional principles, especially regarding respect for federalism. She emphasized that this situation could affect the credibility of judicial institutions and the public's trust in the judicial system.

In particular, Molina mentioned problems such as the appointment of unqualified individuals for jurisdictional functions, citing cases of secretaries acting as heads who do not meet the necessary requirements. She underscored that these errors could have serious repercussions on the proper functioning of the Federal Judiciary.

The judge also criticized the lack of understanding by the Senate in the implementation of judicial reform, pointing out decisions that go against established constitutional rules. She warned about the existence of "implementation vices" that could negatively affect the future of the country by keeping in power judges and magistrates whose suitability is questionable.

Regarding the Disciplinary Tribunal, an entity that will begin operating from September 1, Molina highlighted the contradiction in the appointment of councilors of the Judiciary as part of this tribunal, despite it not being operational yet. She expressed her concern about the possible negative impact of a poorly implemented reform on democracy and the quality of Mexican institutions.

As for the absence of Minister Norma Piña in the candidate lists, despite her belonging to the council's plenary, and the declinations of other councilors such as Lilia Mónica López Benítez that were not reflected in the ballots, the judge questioned the transparency and coherence of the candidate selection process. She stated that the lack of an adequate and precise reform could have serious and widespread consequences for the Mexican judicial system.
