
Deputy Grecia Benavides, from the Morena Legislative Group, has presented an initiative in Nuevo León to ensure that the funds raised through the Green Tax are dedicated exclusively to environmental mitigation and remediation measures. The Green Tax was introduced in 2021 with the purpose of having polluting industries contribute to the repair of ecological damage in the State. However, the lack of clear rules regarding the use of these resources has generated uncertainty and limited their positive impact.
In Benavides's words, "We are proposing in the Tax Law that this tax be used for environmental remediation actions so that by law, the revenues must be used for actions to reduce and combat environmental pollution." The proposal includes the reform of Chapter Five of the Tax Law of the State of Nuevo León, renaming it "Of Ecological Taxes for Environmental Remediation" and establishing the obligation to allocate all income obtained from this concept exclusively to environmental sanitation projects.
From 2023 to 2024, the State has raised more than 3 billion pesos in ecological taxes. However, there is currently no obligation on the part of the state administration to allocate those resources to the fight against pollution. The legislator emphasizes that the law does not specify the purpose of these green taxes and highlights the importance of consulting experts to define the actions in which the raised funds should be invested.
