The organizations Foundation for Justice, Integral Human Rights in Action (DHIA), Institute for Women in Migration (IMUMI), and Alaíde Foppa Legal Clinic for Refugees issued a joint statement denouncing "impunity and selective justice" related to the conditional suspension of the commissioner of the National Migration Institute (INM), Francisco Garduño. This statement rejects the ratification of the conditional suspension by the Collegiate Court of Appeals of the Seventh Circuit in Ciudad Juárez.
In the statement, it is highlighted that the legal process has been marked by inadequate treatment and a lack of effective exercise of legal counseling rights for the affected families. Night notifications, sudden changes in hearing dates, and the absence of notifications regarding important decisions for the victims, such as the public apology, are mentioned. Garduño is demanded to provide a public apology that meets the demands of the families and survivors.
The statement details the agreements reached by the victims and their legal advisors after meeting with the Head of the Executive Commission for Attention to Victims (CEAV) and Garduño's defense attorney. These agreements include the establishment of work tables with the presence of all victims, planning for a Public Apology ceremony in Ciudad Juárez, drafting the text that will contain the public apology, and publishing it in various national and international media.
Additionally, it is proposed that the public apology be delivered by Francisco G. Y., followed by the victims' right to respond to its content. It is established that the apology should be made in Spanish with interpretation into Guatemalan indigenous languages, as several victims are from Maya communities.
The statement also commemorates the second anniversary of the fire at the migration facility in Ciudad Juárez, where 40 people died and many others suffered physical and psychological injuries. On the other hand, it is reported that Sergio Salomón will take over as the new head of the INM in place of Francisco Garduño on May 1, as part of a transition process related to dialogues between governments.
