
Samuel González Ruiz, criminal lawyer and former international advisor to the United Nations, has expressed that Televisa is in a complex situation due to the possible revelation of secrets and illegal practices reported in #TelevisaLeaks. According to González, these practices could lead to significant legal responsibilities, especially in the United States, where the company is governed by transparency and reporting regulations that were not complied with in this case.
The lawyer highlighted that the merger between Televisa and Univisión means that the assets and liabilities of both companies are now part of a single entity, thereby increasing their legal exposure. González mentioned that the disclosures made could have additional legal repercussions, including possible lawsuits in U.S. territory. In this sense, he stated that if the lawyers of affected companies use the disclosed information in a U.S. court, they would not be committing an unlawful act.
Regarding the legality of the recordings of Germán Gómez, the whistleblower who leaked information about "El Palomar" and Televisa's practices, González pointed out that, according to Article 16 of the Mexican Constitution, no crime was committed by recording private conversations in which he participated. He also noted that Televisa should report to the U.S. Securities Exchange any potential impacts arising from the investigations and leaks.
González also warned about the possible legal consequences for violations of copyright and industrial property rights, as Televisa would have used logos, images, and names of other companies in disinformation campaigns. These actions could entail legal sanctions, especially in the United States, where economic competition authorities could investigate the case.
Regarding Televisa's silence in the face of investigations and leaks, González expressed that the company might be evaluating its position due to the possible unlawful conduct revealed. According to the lawyer, Televisa’s actions from its own offices, attacking journalists, companies, and victims of crimes, could lead to considerable legal problems, especially if taken to U.S. courts.
