Judicial Reform Raises Concerns Among Investors

Ana Laura Magaloni, a doctor of law and founding director of the division of legal studies at the Center for Research and Teaching in Economics (CIDE), warns that the judicial reform in Mexico causes more uncertainty among entrepreneurs than the presidency of Donald Trump in the United States.

During an intervention in the program EntreDichos of El Financiero Bloomberg, Magaloni emphasized that the judicial reform in the country generates greater fear among investors compared to what could happen in the judiciary after the election. According to the expert, when speaking with entrepreneurs, she has perceived that the impact of the judicial reform is more significant than that of Trump.

In the same vein, Magaloni mentions that if an investor considers placing their money in Mexico but is unsure about possible changes in the law that could undermine their rights, and also does not have the certainty of having an impartial court to discuss the constitutionality of those regulations, the uncertainty becomes an obstacle to investment. The expert emphasizes that uncertainty is the worst enemy of investment and that the massive dismissal of judges in the country represents an unbelievable situation.

Magaloni expresses her concern about the judicial reform, indicating that it results in a weakening of judicial autonomy and in political control of the Judiciary. She highlights that the pending appointment of a minister with the departure of Luis María Aguilar Morales would have granted four assured votes to control the highest court, deeming the reform in this regard unnecessary. Furthermore, the expert states that these changes reflect ignorance about the function and foundation of judicial bodies, as well as a desire for revenge on the part of former presidents.

In conclusion, Ana Laura Magaloni emphasizes that, from the perspective of investors, the uncertainty generated by the judicial reform in Mexico surpasses the impact that the management of Donald Trump may have in the United States, placing the country in an unfavorable situation for foreign investment.
