The Electoral Tribunal has revoked the fines imposed by the INE on candidates who appeared in the so-called 'accordions' or voting guides. The decision was made by a majority vote in the Superior Chamber. Three justices voted for the revocation, arguing the insufficiency of evidence to prove the materials influenced the election results. They stated that the National Electoral Institute (INE) did not conduct a thorough investigation to prove a causal link between the candidates' appearance in the 'accordions' and any objective benefit. In contrast, another justice proposed to uphold the fines, arguing that the dissemination of the accordion materials, both physical and digital, was aimed at positioning certain candidatures, generating an undue benefit. Another justice, who voted against the revocation, recalled that the 'accordions' constituted mechanisms to influence the will of citizens with the intention of affecting the freedom of suffrage. The decision concerns fines that collectively exceeded 6.3 million Mexican pesos.
