The president of the Senate's Directing Board, Gerardo Fernández Noroña, stated that it is unlikely that President Claudia Sheinbaum will be prosecuted for failing to comply with the order to remove the judicial reform from the Official Daily of the Federation. According to Fernández Noroña, the reform is already a valid law and must be respected, which is why he defended that judicial elections will take place next year. He also emphasized that the Law establishes that the protection trial does not proceed against constitutional reforms.
Regarding Judge Nancy Juárez, from the Ninth District in Veracruz, she declared that if Sheinbaum does not withdraw the publication of the judicial reform from the DOF, the law obliges her to notify the Federal Public Ministry. The judge pointed out that failing to comply with this order would amount to a crime of contempt of a judicial resolution, which would lead to notifying the federal Public Ministry to continue with the legal procedure.
Juárez mentioned that she has not yet been able to confirm whether the corresponding authorities have been notified of the resolution requesting the removal of the reform from the DOF, but once the delivery of the judicial document is verified, 48 hours would be granted to comply with the suspension. She clarified that she has no influence over the decisions made by the Public Ministry regarding whether the crime of contempt is constituted or the possibility that the Attorney General's Office requests an arrest warrant against the President or the authorities that fail to comply with the judicial order.
