
Judge Nancy Juárez, from the Nineteenth District in Veracruz, has given an ultimatum to President Claudia Sheinbaum to withdraw the judicial reform from the Official Journal of the Federation (DOF) under the threat of committing an offense if she does not comply. According to Juárez, Article 107 of the Constitution and Article 252 of the Amparo Law are clear on this matter, and in case of contempt of the judicial resolution, the authority would be obliged to inform the Public Prosecutor's Office of the Federation.
Juárez mentioned that, although she cannot prove whether the authorities have already been notified of the resolution requesting the elimination of the reform from the DOF, should they be, they would have 48 hours to comply with the suspension. She herself would not be part of the decisions made by the Public Prosecutor's Office regarding possible offenses of contempt or the request for an arrest warrant.
Senator Saúl Monreal proposed to subject Judge Nancy Juárez to political trial for that decision. However, Sheinbaum has already stated that she will not comply with the order, considering that the judge exceeded her functions. Monreal argues that the judge has violated the public and popular interest by obstructing the judicial reform.
By halting the reform, the judge is going against the popular will expressed in the Legislature and is hindering the necessary modernization of the judicial system to guarantee greater transparency, efficiency, and access to fundamental rights. Any citizen can report this case of contempt and thus initiate a process in the Chamber of Deputies that could lead to a political trial in the Senate of the Republic.
