The Government of Mexico, led by Claudia Sheinbaum, proposes to regulate work on digital platforms, granting labor rights and social security to drivers and delivery workers. The changes aim to protect workers and establish fairer conditions in the sector.

Proposal for the regulation of platform work in Mexico

One of the main concerns for both users and those who generate income through digital platforms like delivery workers or drivers in Mexico is the increase in prices and commissions imposed by the multinational companies operating in the country, such as DiDi, Uber, Rappi, among others. These companies have announced adjustments to their rates and commissions, causing unease among users and platform workers.

In the "Terms and Conditions" of applications like DiDi Food and Uber Eats, it is stated that prices may be adjusted according to real-time demand, which could result in substantial increases during periods of high demand. Additionally, the platforms calculate the minimum service costs based on distance and time.

Rolando Silva Briceño, a member of the Technical Commission on Social Security of the College of Public Accountants of Mexico, notes that the government cannot regulate price increases, as it is a self-regulated market. On the other hand, delivery workers and drivers have expressed concern over the commissions that the platforms have reduced in recent years, decreasing their earnings per trip.

In response to this situation, the Government of Mexico has proposed a series of regulations that would affect these platforms and the workers operating through them. Among the proposed measures is the regularization of work on platforms for drivers and delivery workers, the creation of a transitional regime for companies to implement mandatory social insurance, and the protection of workers' labor rights.

Despite the initial doubts and fears of losing independence, it is mentioned that workers will still be able to choose their schedules and working platforms, but there will also be limited recognition of subordination to the time effectively worked. With these measures, the aim is to guarantee the social security of those who generate income through these platforms and establish clear rules for the benefit of the workers.
