
The opposition has criticized the reform initiative presented by Morena in the Senate, labeling it as an act of 'authoritarianism' and 'madness'. Guadalupe Murguía, coordinator of the PAN bench, has warned that the proposal should not have retroactive effects, especially regarding the judicial reform. According to her words expressed at a press conference, this initiative reveals Morena's authoritarianism by attempting to guarantee the unchallengeability of constitutional reforms, which could be interpreted as an implicit acknowledgment of the validity of current legal resources.
PRI member Alejandro Moreno has also criticized the initiative, calling it 'madness' and accusing Morena of trying to silence judges and magistrates. He has highlighted that the proposal demonstrates an evident acknowledgment of the powers of the Supreme Court of Justice to review the judicial reform, which, in his view, undermines the democratic regime.
The reform proposed by Morena seeks to guarantee the unchallengeability of constitutional reforms, such as the judicial one. It aims to make amendments to Articles 103, 105 of the Constitution and reform Article 107 to establish that no resource, such as amparo or actions of unconstitutionality, would be permissible against reforms to the Constitution. The initiative also includes provisions in the transitional articles so that, once published, any ongoing trial related to the judicial reform becomes null and is dismissed.
The initiative has already been referred to the Constitutional Points and Legislative Studies commissions for analysis and discussion. Opposition senators have highlighted their concern regarding the lack of clarity about the retroactivity of this reform and have expressed their opposition to it.
