
The president of the Senate's Board of Directors, Gerardo Fernández Noroña, reported that an initiative presented by legislators from Morena was assigned to the joint commissions of Constitutional Points and Legislative Studies. It is expected that this proposal will be approved on Thursday. The initiative was signed by Fernández Noroña, the president of the Board of Directors of the Chamber of Deputies, Sergio Gutiérrez, and Ricardo Monreal. The latter explained that the proposal seeks to reaffirm constitutional supremacy and the reforming power, as they believe they are permanent constituents.
It proposes elevating to constitutional rank the first section of Article 61 of the Amparo Law, which establishes the impossibility of resorting to the amparo trial or actions derived from it, such as suspensions, against reforms to the Constitution. According to Monreal, the initiative aims to prevent actions such as amparo, actions of unconstitutionality, or controversies against reforms and their legislative process.
On the other hand, opposition leaders have labeled this initiative as an act of authoritarianism by Morena. Guadalupe Murguía from the PAN expressed that it is a demonstration of the authoritarianism of the ruling party. Alejandro Moreno from the PRI pointed out that the proposal seeks to silence judges and magistrates, which he considers madness.
The initiative presented in the Senate proposes to amend Articles 103, 105, and 107 of the Constitution to establish that amparo trials or means of control against constitutional reforms do not proceed. Adán Augusto López, Morena's leader in the Senate, highlighted that constitutional reforms represent the sovereign will of the Mexican people and that the Judiciary must defend the Constitution without modifying it.
The initiative seeks to prevent resources such as amparo from invalidating constitutional reforms. It proposes to repeal provisions contrary to the content of the reform from its entry into force and prohibits analogous interpretations in the transitional articles.
