
Senator Adán Augusto López Hernández reported that the united commissions of Legislative Studies and Constitutional Points have begun to discuss an initiative of "constitutional supremacy" to make reforms to the Constitution unchallengeable, excluding reforms to articles 1 and 105 of the Constitution and all transitional provisions. The aim is to clearly establish in the Political Constitution what is stated in the Amparo Law regarding the inadmissibility of the amparo trial against additions or reforms to the Constitution, including those related to electoral matters.
In an interview, López Hernández emphasized that the initiative aims to reinforce what has been established by the Supreme Court of Justice of the Nation, which has maintained that the constitutionality of additions or reforms to the Political Constitution cannot be questioned. It was mentioned that despite the Amparo Law excluding constitutional reforms from the amparo trial, some judges and magistrates have tried to hinder the implementation of judicial reforms.
The representative of Morena indicated that the proposal to modify article 1 of the Constitution, related to human rights, will be removed from the project. The discussion will focus on articles 103, 105, and 107 of the Constitution, which are linked to the reform of the Judiciary, during the upcoming meeting of the united commissions of Constitutional Points and Legislative Studies.
